Terms of Service

1. Acceptance of Terms

By accessing or using Replify, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

2. Description of Service

Replify provides a WhatsApp inbox management platform with AI-powered auto-reply capabilities. The Service connects to WhatsApp Business API via Meta Cloud API to send and receive messages on your behalf.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

• Replify offers a free 14-day trial. No credit card is required to start.
• After the trial, continued access requires a paid subscription (Starter, Growth, or Agency plan).
• Subscriptions are billed monthly in advance and renew automatically unless cancelled.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial months, except where required by law.
• We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk messages to people who have not opted in.
• Violate WhatsApp's Terms of Service or Business Policy.
• Send fraudulent, misleading, or illegal content.
• Harass, abuse, or harm any person.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Violate any applicable law or regulation.

6. AI Features

Replify uses artificial intelligence to generate automated replies. You acknowledge that:

• AI-generated responses may not always be accurate or appropriate.
• You are responsible for reviewing AI replies and for all messages sent on your behalf.
• We are not liable for any outcomes resulting from AI-generated content.

7. Data and Privacy

Your use of Replify is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described therein.

8. Intellectual Property

Replify and its original content, features, and functionality are owned by Esipick and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Third-Party Services

The Service integrates with third-party platforms (WhatsApp, Meta Cloud API, Stripe, Anthropic, OpenAI, ElevenLabs). Your use of those services is subject to their respective terms. We are not responsible for the availability or conduct of third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, Esipick shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

12. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may terminate your account at any time from the Settings page. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email and by posting the updated Terms on this page. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.
